Thesis defended : "Transitional Justice and right to a fair trial in the Ivory Coast political and legal system reconstruction"

Abstract:
 
Transitional justice and the right to a fair trial. Here are the main topic of this reflection. Through this analysis, the reflection tries to draw some attention to due process of law in post crisis context. A valuable example is given by the ivorian case.
The Republic of Côte d’Ivoire experienced civil war and polical breakdown. The post-election dispute and resurgence of violence after the presidential elections in 2010-2011 was the climax. It is now important to see how the country is trying to rebuilt his nationhood, his political and juridical system and create a peaceful environment for human rights.
In this context, we need to consider the effectiveness of legal system and its approach in the ivorian’s post-conflict reconstruction. That is how transitional justice and the right to a fair trial are entitled to act as useful instruments to lead Côte d’Ivoire into democractic values and due respect of fundamental rights.
Thus, by asserting that the Republic of Côte d’Ivoire fail to fail to protect and respect an international fondamental right as fair trial in context of post crisis, the reflection highlights the role of transitional justice and its mechanisms in the process of reinforcing respect and promotion of the right to a fair trial in the country’s political, juridical legal system.
